Terms and Conditions and User Guide

Introduction

Welcome to Cosmx ("hereinafter referred to as the Platform"). By accessing and using our Platform, you ("Seeker" if availing services, or "Guide" if offering services) agree to be bound by these Terms and Conditions ("Terms") and acknowledge our Privacy Policy. If you do not agree, you should not use the Platform.

This Platform is owned and operated by Sobreva Ventures Private Limited ("us", "We", "the Company" or "Cosmx" which also includes its affiliates). The Platform may be provided or be accessible via multiple websites or applications whether owned and/or operated by us or by third parties, including, without limitation, the website www.cosmx.app and its related apps.

The following Terms and Conditions (the "Agreement") govern your access and use of our online platform through which consulting, information related to Astrology, Fortune Telling, Numerology, Vastu & Energy Alignment, Interpretive Sciences, Healing & Energy Work, Life Coaching, Wellness & Counselling, Therapy and other allied sciences are administered and accessible to any person, and your use of cosmx Intelligence.

By accessing or using the Platform, you are entering into this Agreement. You should read this Agreement carefully before starting to use the Platform. If you do not agree to be bound to any term of this Agreement, you must not access the Platform.

When the terms "we", "us", "our", "company" or similar are used in this Agreement, they refer to any company that owns and operates the Platform ("Sobreva Ventures Private Limited").

General Description

The Platform is an internet-based portal having its existence on World Wide Web, Application and other electronic medium and provides a platform for obtaining Astro Wellness through engagement of services of verified practitioners offering consultations across various interpretive sciences, energy work, coaching and therapy domains. A brief description of the services offered, but not limited to, are as hereinbelow:

  • Tarot
  • Fortune Telling
  • Numerology
  • Vastu & Energy Alignment
  • Healing & Energy Work
  • Life Coaching
  • Wellness & Counselling
  • cosmx Intelligence, an AI companion provided directly by us (see the section "cosmx Intelligence" below)

Definitions

  • "Seekers": Registered users who seek or book consultations and services offered on the Platform.
  • "Guides": Verified practitioners, coaches, therapists, healers, and consultants providing services listed on the Platform.
  • "Services": Includes any consultation, session, reading, guidance, or practice offered under categories such as Astrology, Tarot, Fortune Telling, Numerology, Vastu & Energy Alignment, Interpretive Sciences, Healing & Energy Work, Life Coaching, Wellness & Counselling, and other related fields.
  • "Platform": The Cosmx website, mobile application, and associated services.
  • "cosmx Intelligence": The AI companion available inside the Platform, including chat, readings it generates, audio content played within it, and related features.
  • "Memory": The ability of cosmx Intelligence to retain your past conversations, preferences and context to personalise future replies.
  • "Your Content": Anything you type, select, upload or otherwise submit to cosmx Intelligence.

Eligibility

  • You must be at least 18 years old to create an account or use cosmx Intelligence. By creating an account, you confirm that you are 18 or above. If we learn that a user is under 18, we may suspend or close the account. Any unauthorised or unapproved use is at the sole risk of the user, without any liability of the Platform or the Guides (including the AI interface).
  • Seekers booking mental health, wellness, or therapy-related services must ensure they are of legal consenting age in their jurisdiction.
  • Guides must provide accurate qualifications, certifications, and legal documentation for verification before listing services.

Scope of Services

  • The Platform acts as a marketplace connecting Seekers with Guides.
  • We are not responsible for the content, advice, interpretations, or claims made during Guide sessions. All services are intended for guidance, personal growth, and well-being support, not as replacements for licensed medical, legal, or financial advice.
  • Some categories, like Wellness & Counselling or Mental Health, may involve licensed professionals. Seekers must confirm the credentials of their chosen Guide.
  • In addition to the marketplace, we provide cosmx Intelligence directly. cosmx Intelligence is not a Guide and is not a Guide service. Its use is governed by the section "cosmx Intelligence" below, in addition to the rest of these Terms.

cosmx Intelligence

1. What it is. cosmx Intelligence is an AI companion. Its replies are generated by artificial intelligence models and calculation tools, and are not written or checked by a human or a Guide before you see them.

2. Early access. cosmx Intelligence may be offered as a beta or early access feature. Features may change, be limited or be withdrawn, and the service may sometimes be unavailable.

3. Consent before use. Before your first conversation, you will be shown a short notice that links to the Privacy Policy. By tapping "Accept & Continue", and by continuing to use cosmx Intelligence, you agree to use it on these Terms, and you agree to the processing of Your Content as described in the Privacy Policy, including that cosmx Intelligence may remember your conversations, that conversations may be reviewed for safety, and that they may be used internally to evaluate and improve the service. You may withdraw consent at any time by writing to support@cosmx.app, as described in the Privacy Policy.

4. Nature of replies. cosmx Intelligence is built to support reflection and self-understanding. It does not predict or guarantee events or outcomes. It does not recommend, sell or assess remedies, rituals, gemstones or similar products. It does not give medical, psychological, psychiatric, legal or financial advice, and it is not therapy or counselling. Any Guide you book is independent of cosmx Intelligence.

5. Accuracy. AI replies can be inaccurate, incomplete or unsuitable for your situation, including readings calculated from the birth details you give us. You are responsible for checking anything important and for the decisions you make. Please do not rely on cosmx Intelligence as your only source for decisions about your health, safety, relationships, money or legal matters.

6. If you are in crisis. cosmx Intelligence is not an emergency service. If you are thinking about harming yourself or someone else, or are in danger, contact emergency services (112 in India) or Tele MANAS (14416 or 1-800-891-4416) immediately. cosmx Intelligence may share helpline details with you and we may, at our discretion, have a member of our team review a conversation, but we do not monitor conversations in real time and we do not guarantee that any situation will be recognised or that any intervention will follow.

7. Acceptable use. You agree not to use cosmx Intelligence to: (a) do anything unlawful, harmful, abusive, hateful or sexually explicit; (b) seek content involving minors in any sexual or harmful context; (c) try to make it bypass its safety rules, or extract its instructions, prompts or underlying models; (d) scrape, automate access to, resell or build a competing service from it; (e) submit other people's personal data without a lawful basis; or (f) impersonate any person. We may limit, suspend or end your access to cosmx Intelligence if you breach this clause.

8. Your Content. You keep ownership of Your Content. You grant us a non-exclusive, royalty-free, worldwide licence to host, process, review and use Your Content to provide, secure, evaluate and improve cosmx Intelligence and our services, in each case as described in the Privacy Policy. You confirm you have the right to share Your Content. You may withdraw your consent at any time by writing to support@cosmx.app, and we will act on it as set out in the Privacy Policy.

9. Replies. You may use the replies you receive for your own personal, non-commercial purposes. Similar replies may be given to other users. The cosmx Intelligence software, design, prompts, models, audio and other content remain our property or that of our licensors.

10. Access and subscription. cosmx Intelligence includes a free daily window. When it runs out, chat is paused until the window resets or until you subscribe. Plans, billing, cancellation and refunds are set out in the Pricing Policy.

11. Safety review and privacy. Conversations that suggest a risk of serious harm may be reviewed by authorised personnel as described in the Privacy Policy. Guides cannot see your cosmx Intelligence conversations. Any future feature that shares a summary with a Guide will require your separate consent.

12. Security incidents and dispute redressal. No online system is completely secure. We follow reasonable security practices. If there is a security incident (such as a server failure, malware attack or data breach) affecting the Platform or a third-party service provider we use (such as Amazon Web Services or another cloud hosting provider), we will give notice to affected users and to authorities as required by law, through the app and the website, so that users can take appropriate steps to safeguard their interests. To the maximum extent permitted by law, we are not responsible for harm caused by such events beyond our reasonable control, except to the extent that the harm results from our failure to maintain the reasonable security practices required by law. Any dispute may be addressed to our Grievance Officer at support@cosmx.app.

User Responsibilities

For Seekers:

  • Provide accurate booking and payment information.
  • Use services responsibly and understand that outcomes are subjective and cannot be guaranteed.
  • Seek appropriate professional help in situations of medical or psychological emergencies; the Platform, including cosmx Intelligence, is not a crisis intervention service.
  • Provide current, complete and accurate information about yourself as prompted to do so by the Platform.
  • Not impersonate another person while providing personal data.
  • Maintain and update the above information as required to keep it current and complete.
  • Use cosmx Intelligence in line with the acceptable use rules above.
  • Indemnify us against losses, claims and costs arising from your breach of these Terms or misuse of the Platform or cosmx Intelligence, to the extent permitted by law.

For Guides:

  • Provide truthful information about qualifications, skills, and domains of practice.
  • Deliver services ethically, respecting confidentiality and professional boundaries.
  • Avoid providing medical diagnoses or financial/legal guarantees unless professionally licensed and lawfully permitted.

Payments and Pricing

  • All service fees are displayed on the Platform and are to be paid to the Platform in advance through approved payment gateways or, for cosmx Intelligence subscriptions, through our payment gateway partner, Google Play, the Apple App Store, or another payment method shown at the time of purchase.
  • The Platform may charge a commission on Guide earnings, details of which will be outlined separately.
  • Refunds may be issued only under specific circumstances (for example, non-delivery of service or technical malfunction) in accordance with our Refund Policy and, for subscriptions, the Pricing Policy and the applicable app store's policies.
  • The services availed by the Seekers and those provided by the Guides are intended for personal use only and any and all agreements and conditions of use are completely non-transferable.

Confidentiality and Privacy

  • Both Seekers and Guides agree to maintain confidentiality regarding sessions.
  • Guides must not share personal details of Seekers without consent.
  • The Platform collects and processes personal data in line with its Privacy Policy.
  • Seekers may request deletion of their personal data by writing to support@cosmx.app. A request that relates to information shared with a Guide in a Session may also be brought to that Guide's notice. Requests relating to cosmx Intelligence are handled by us and do not need to be notified to Guides, who do not have access to cosmx Intelligence conversations.
  • You can ask us to stop remembering your cosmx Intelligence conversations, or to delete them, by writing to support@cosmx.app.

Code of Conduct

  • No harassment, abuse, or inappropriate behavior will be tolerated.
  • Content that promotes hate speech, discrimination, or misinformation is prohibited.
  • Any violation may result in account suspension or termination.

Disclaimers

  • All services on this Platform (Astrology, Tarot, Fortune Telling, Numerology, Vastu, Energy Alignment, Life Coaching, Interpretive and Healing Sciences, Wellness and Counselling, and cosmx Intelligence) are for informational and entertainment purposes only, and are meant for guidance, self-reflection, self-development and supportive purposes. They do not constitute medical, psychiatric, legal, or financial advice.
  • The Platform does not guarantee any outcomes, results, or accuracy of predictions in interpretive sciences, fortune-telling, or spiritual practices, or any specific outcome or accuracy of readings, assessments or advice. Past records or testimonials are not indicative of future results.
  • Engagement with services is voluntary and at the user's own discretion. Results may vary from person to person, depending on several individual and unknown factors.
  • The Platform and its service providers do not promise the prevention, treatment, or cure of any disease, mental health, or financial condition.
  • Mental health, therapy, wellness and financial well-being services provided by Guides must not be substituted for emergency psychiatric, medical care or to be construed as expert advice on financial management and planning.
  • cosmx Intelligence is provided "as is" and "as available". Its replies are generated by AI models and calculation tools that we may update from time to time. To the extent permitted by law, we do not warrant that it will be accurate, current, uninterrupted or error free. Please use your own judgement and consult a qualified professional where appropriate.
  • Disclaimers are displayed with advice, services and advertising in accordance with Indian law and the Advertising Standards Council of India (ASCI) guidelines.

Not Crisis Support

The Platform does not provide crisis or emergency psychological assistance. In case of crisis situations (including thoughts of self-harm), users are advised to seek immediate help from qualified local professionals or helplines. cosmx Intelligence is designed to recognise some signs of distress and respond by sharing helpline information. It may not recognise every situation and it is not an emergency service. In India you can call Tele MANAS on 14416 or 1-800-891-4416, or the emergency number 112.

Limitation of Liability

  • The Platform is not liable for actions, advice, or claims made by any Guide.
  • Seekers engage in services at their own discretion and risk. You acknowledge that cosmx Intelligence is an AI tool, that its replies may be wrong, and that you use and act on them at your own risk.
  • To the fullest extent permitted by law, the Platform disclaims liability for damages, losses, or disputes arising from services delivered, and shall not be liable for any indirect, incidental, special or consequential loss, or any loss of profit, data, goodwill or opportunity.
  • To the fullest extent permitted by law, our total liability arising out of or relating to cosmx Intelligence shall not exceed the greater of (a) the subscription fees you paid us for cosmx Intelligence in the 12 months before the event giving rise to the claim, and (b) INR 1,000.
  • Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. If any provision of this section is held unenforceable, it applies to the maximum extent permitted and the rest remains in effect.
  • All content and services are provided "as is" and without warranties of any kind, to the extent permitted by law.

Account Suspension and Termination

  • The Platform reserves the right to suspend or terminate any account for violations of these Terms, fraudulent activity, or any misuse of services, without issuing any warning or assigning any reason thereof and shall be in the sole discretion of the management.
  • Guides found misrepresenting credentials or engaging in unethical practices may face permanent removal.
  • The Platform reserves its right to terminate the accounts of both Guides and Seekers who are found to be engaging in conversations relating to inter-se intimacy or solicitation of sexual services of any sort, child abuse, dating or matchmaking provocative comments and/or religious hate comment. Such rights shall be exercised without notice and may be reported to appropriate authorities, if required.
  • We may suspend or end access to cosmx Intelligence alone, without closing your account, if you breach its acceptable use rules or for any other reason in our discretion.

Intellectual Property

  • All Platform content, branding, trademark and technology remain the sole property of Cosmx.
  • Guides retain intellectual property rights over their original material but grant the Platform a limited license to promote their services.
  • Ownership of Your Content and of cosmx Intelligence replies is set out in the section "cosmx Intelligence" above.

Any reference or link to external websites is for user convenience only. The Platform is not responsible for the content or privacy practices of third-party sites.

Force Majeure

  1. If either of the users is prevented or delayed from or in performing any of their obligations under the terms of use by force majeure events such as acts of God, war, riots, strikes, or any order of the local/state/central government etc., then such user may notify the other party of the circumstances constituting the force majeure and of the obligation, the performance of which is thereby delayed or prevented, and the party giving notice shall thereupon be excused from the performance or punctual performance, as the case may be, of such obligation for as long as the circumstances of prevention or delay may continue. The above circumstance shall include a situation in the nature of digital shutdown, malware attacks, internet blockages, cyber-attack, outage of a third-party cloud or AI infrastructure provider or other events of similar nature.

  2. If by virtue of the preceding sub-clause either of the user shall be excused from the performance or punctual performance of any obligation for a continuous period of two months, then either of the user may at any time thereafter and, provided such performance or punctual performance is still excused, by notice to the other, terminate the Agreement.

Governing Law and Jurisdiction

  • These Terms are governed by the laws of India.
  • Any disputes will be subject to the exclusive jurisdiction of the courts located in Mumbai, India.

Notices

Except as otherwise stated in these Terms of Service, all notices to a party shall be in writing and shall be made via email. Notice shall be deemed given 72 hours after an email is sent, to the member at the address provided by the Seeker in the Registration Data and to the Platform at the email address set forth below:

Modifications

  • The Platform reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform, and continued use indicates acceptance of the changes. For material changes, we will notify you in the app or on the website. Where the law requires fresh consent, for example a new use of your cosmx Intelligence data, continued use alone will not count as consent and we will ask you separately.
